A. Between unmarried parents
The children’s act of 2005 sets out useful ways that unmarried parents may resolve dispute regarding responsibilities and rights of a child. Points that are communally mediated are:
Disputes between people claiming responsibilities and rights of parents.
Disputes over where the child is to live and how decisions regarding the care for the child are to be made.
Various other matters regarding parenting of the child.
B. Divorce mediation
Reaching agreement at the time of divorce to the best interest of the child/ children is not always straightforward. Divorce is a stressful time for all involved. Mediated parenting-plans aim to help protect the children in the family, so that their best interests are served. Points that are communally mediated are:
Structure decision-making regarding important issues such as education, extra-mural activities, medical care and religion between them.
A Residency Plan, which would determine where the children would live when.
Remedies for any other difficulties, e.g. phasing in of contact, alienation, monitoring of substance abuse, domestic violence and other problems.
C. Parenting rights and responsibilities after divorce
The needs of children changes over time including the circumstances of the divorce parents or separated parties. Parenting plans need to be revised from time to time to ensure that the realities of the needs are reflected and the best interest of the child/ children are continuously served. Mediation provides a constructive method to explore solutions to accommodate these changes.
D. Mediating family disputes’
Intact families my from experience internal conflict that may result in destructive relationship. Having a 3rde party engages in resolving the conflict that is not emotionally attached may provide the equalizer to ensure that this family could resolve the issues in a constructive an positive manner.
